1. Acceptance of terms
By accessing or using cascadiaatelier.com (the “Site”), you agree to these Terms of Service. If you do not agree, please do not use the Site.
2. Description of services
Cascadia Atelier is the trade name of Cascadia Atelier Works Inc., a British Columbia corporation (BC1597782), with its registered office in Colwood, British Columbia, Canada. In these Terms, “we,” “us,” and “our” refer to that corporation.
The Site is an informational presence for the studio’s work; specific service offerings are described on the Site as they become available. Nothing on the Site constitutes a binding offer of services unless and until a written engagement is executed by both parties.
3. Order of precedence
These Terms govern your use of the Site. They do not govern services we provide under a written engagement. Where a signed engagement agreement, statement of work, or master services agreement between you and Cascadia Atelier Works Inc. conflicts with these Terms, that agreement governs to the extent of the conflict, and these Terms continue to apply to everything it does not address.
4. User obligations
When using the Site, you agree:
- To use the email addresses published on the Site only for genuine inquiries related to our work;
- Not to scrape, harvest, or otherwise extract content or data from the Site by automated means;
- Not to attempt to gain unauthorized access to any part of the Site or its underlying infrastructure;
- Not to use the Site to transmit unlawful, harassing, defamatory, or otherwise objectionable material;
- To comply with all applicable laws in your use of the Site.
5. Intellectual property
All content on the Site — including text, graphics, logos, marks, design, and code — is owned by Cascadia Atelier Works Inc. or its licensors and is protected by Canadian and international intellectual property law. You may view and share the Site for personal, non-commercial purposes; any other use requires our prior written permission.
If you send us content by email or otherwise, you retain ownership of that content. You grant us a limited, non-exclusive licence to use it solely to respond to and act on your inquiry.
6. Suspension and termination of access
These Terms apply for as long as you use the Site. You may stop using the Site at any time.
We may suspend, restrict, or block your access to the Site, in whole or in part, at any time and without notice, if we reasonably believe you are using it in breach of Section 4 or in a way that threatens the security, availability, or integrity of the Site or its underlying infrastructure. We may also change, suspend, or discontinue the Site, or any part of it, at any time and without notice.
Section 5 (Intellectual property), Section 7 (Limitation of liability), Section 9 (Governing law), and Section 10 (General provisions) continue to apply after any suspension, termination, or discontinuation, in respect of your prior use of the Site.
7. Limitation of liability
The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Cascadia Atelier Works Inc. and its directors, officers, employees, and agents disclaim all warranties, express or implied, and shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site.
Nothing in these Terms limits liability that cannot be excluded under applicable law.
8. Third-party links
The Site may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of those sites.
9. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts of British Columbia for any dispute arising from these Terms or your use of the Site.
10. General provisions
Severability. If any provision of these Terms is found to be unenforceable, that provision is severed and the remaining provisions continue in full force.
Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us in respect of your use of the Site, and replace any prior understanding on that subject. Section 3 governs where a written engagement agreement is in place.
No waiver. A failure or delay in enforcing any provision of these Terms is not a waiver of it, and a single or partial exercise of a right does not prevent any further exercise of that or any other right.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms to an affiliate, or to a successor in connection with a merger, reorganization, or sale of all or substantially all of our assets.
11. Modifications
We may modify these Terms from time to time. Material changes will be reflected in the “Last Updated” date and version number above. Continued use of the Site after a modification constitutes acceptance of the revised Terms.
12. Notices and contact
Notices to us under these Terms are given in writing, by email to the address below. Notices to you are given to the email address you used to contact us. A notice sent by email is deemed to have been received on the next business day after it is sent, unless the sender receives a delivery-failure notification; in these Terms, a business day is a day other than a Saturday, Sunday, or statutory holiday in British Columbia. Changes to these Terms are notified by publication on the Site, as described in Section 11.
